Attempt to call city council meeting fails

Two members of the Hazlehurst City Council tried to call a meeting of the council this week but City Attorney Ken Smith’s office said the request for the meeting violated Section 2.19(b) of the City Charter.
In an email to City Clerk Vernice Thompson, Smith’s partner and son Cason Smith said since the meeting was not properly called, the meeting was invalid and cannot conduct city business at the meeting, if it were to be held.
The meeting was not held.

The city charter says this about called meetings:
Special meetings of the city council may be held on the call of the mayor or on the
written call of any two council members which is consented to by a third council member.
For any called meeting initiated by two council members, such written call shall be delivered
to the city clerk who shall then contact the other council members to determine if there be
a third council member who consents to such call and if there be, then notice as hereinafter
provided shall issue. Notice of such special meetings shall be delivered to each member of
the city council personally, by registered mail, or by electronic means, at least 24 hours in
advance of the meeting. Such notice to each member of the city council shall not be required
if the entire city council is present when the special meeting is called. Such notice of any
special meeting may be waived by a member of the city council in writing before or after
such a meeting and attendance at the meeting shall also constitute a waiver of notice. The
notice of such special meeting shall state what business is to be transacted at the special
meeting. Only the business stated in the call may be transacted at the special meeting.
